Terms and Conditions

These Terms and Conditions ("Terms") govern your relationship with the Elsewedy Eshop online store (eshop.elsewedy.net) and the services it offers. Accessing or browsing the store, or submitting an order through it, constitutes your express acceptance of these Terms and a commitment to abide by them. They are issued in accordance with the applicable Egyptian legislation, including the Consumer Protection Law No. 181 of 2018 and the Personal Data Protection Law No. 151 of 2020. If you do not accept these Terms, you must refrain from using the store.

1. General Provisions

1.1 "Customer" means anyone who accesses the store, views its content or benefits from its services. "The Company" means Elsewedy Engineering Industries and its affiliates, including the Arab Company for Industry and International Trade and Elsewedy Lighting, the owner and operator of the store and seller of its products.

1.2 The Company may amend or update these Terms by publishing the changes on the store; an amendment takes effect from its publication date and applies to orders placed after it. The Customer is responsible for reviewing this page periodically.

2. Customer Account and Obligations

2.1 Opening a personal account may be required to complete a purchase, in which case the Customer must enter accurate, current and complete information, including full name, a valid email address and an active phone number.

2.2 The Company may suspend or close an account if it contains incorrect or misleading information, or if there is reason to suspect fraud or misuse.

2.3 The Customer alone is responsible for keeping login details confidential and for everything done through the account, and must notify the Company without delay upon becoming aware of any unauthorized use.

2.4 By opening an account, the Customer declares that they are at least eighteen years old and have full legal capacity to contract under Egyptian law.

2.5 The Company may decline any order and may limit or cancel quantities requested. If the Company amends or cancels an order, it will seek to notify the Customer via their registered email or phone number, and amounts paid will be refunded in accordance with the Shipping and Return Policy.

2.6 The Customer may not copy, reproduce, sell, resell or trade in any part of the store's services or products without the Company's prior written permission.

3. Products and Their Details

3.1 The Company strives for product descriptions, specifications and images to match reality as closely as possible, but they are presented as a guide and minor differences may exist between them and the actual product, including colour variation depending on the display screen.

3.2 Products are covered by a warranty whose period and terms are stated on the product page or in the documents accompanying its packaging. Defects arising from misuse, incorrect installation or storage, or unauthorized modification are excluded from the warranty.

3.3 Product availability depends on stock, and the Company may modify product specifications or withdraw products without prior notice.

4. Prices and Payment

4.1 All prices are displayed in Egyptian pounds and include value-added tax; they are subject to change at the Company's discretion. The price displayed at the moment the order is confirmed applies.

4.2 The total amount due, including shipping fees, appears at checkout before the purchase is completed.

4.3 If an obvious error appears in a displayed price or statement, the Company may correct it or cancel the order, and the Customer will be refunded in full.

4.4 Payment may be made by credit or debit card (Visa and Mastercard) through the Company's approved payment provider, or in cash on delivery under the conditions in the Shipping and Return Policy.

5. Order Fulfilment and Delivery

5.1 Delivery times and all other shipping and delivery provisions are governed by the Shipping, Return and Exchange Policy published on the store (https://eshop.elsewedy.net/pages/shipping-return-policy).

5.2 The Company is not liable for any delay caused by reasons beyond its control.

5.3 Ownership of the product and the risk of its loss or damage pass to the Customer upon payment of the full price and receipt of the product.

5.4 The Customer must inspect the package on receipt and record any visible damage on the delivery document.

6. Returns, Exchanges and Refunds

The Shipping, Return and Exchange Policy published on the store governs all provisions on returns, exchanges and refunds and forms an integral part of these Terms. In case of conflict between them on this matter, the said policy prevails.

7. Data Protection and Privacy

The Company undertakes to safeguard your personal data in accordance with Egyptian law and the Privacy Policy published on the store, and your use of the store constitutes acceptance of the data collection, processing and storage practices described in it.

8. Processing of Electronic Payments

The Company does not retain your card details in their original form. Electronic payments are processed through approved banks and payment gateway operators in accordance with international card scheme rules and the PCI-DSS security standard, and the process may require additional authentication steps such as a one-time password (OTP) or 3D Secure authentication. The Customer remains responsible for the accuracy and validity of their card details.

9. Rules of Lawful Use

The Customer must use the store for lawful purposes only, and may not attempt to breach it or disrupt its operation, use automated tools to extract its content, provide incorrect information, or use it in a way that violates the law or infringes the rights of others.

10. Intellectual Property Rights

All elements of the store, including logos, trademarks, images, text and designs, belong to the Company or its licensors and are protected by intellectual property laws; they may not be transferred, republished or used without prior written consent.

11. Limitation of Liability

11.1 The Company is not liable for indirect, incidental, special or consequential damages, including loss of profits, data or business opportunities, arising from use of the store or products purchased from it.

11.2 The Company's total liability for any claim is limited to the price of the product related to it.

11.3 The Company bears no responsibility for losses or unauthorized transactions arising from circumstances beyond its reasonable control, provided that payment processing was carried out through approved service providers.

11.4 Nothing above affects the rights granted to the Customer by the Consumer Protection Law.

12. Force Majeure

The Company bears no responsibility for any delay or failure to perform its obligations due to causes beyond its reasonable control, such as natural disasters, adverse weather, government decisions, unrest, and interruptions of telecommunications, electricity or technical systems.

13. Consent to Promotional Communications

13.1 By opening an account or completing a purchase, you acknowledge that you have read and understood the Privacy Policy, and you authorize the processing of your data to fulfil orders and for promotional purposes, in accordance with that policy and Egyptian law.

13.2 You authorize the Company to contact you by email, text message or WhatsApp to inform you of order updates and to send offers and promotional product information.

13.3 You may withdraw this consent at any time using the unsubscribe link or by contacting customer service; this does not prevent essential messages about your orders from reaching you.

14. Quotations and Installation Service

The installation service is offered to individuals (natural persons) and not to companies. Quotations and installation services requested through the store are subject to special terms and prices, specified and confirmed in writing before execution.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Arab Republic of Egypt, and the competent courts of Cairo have jurisdiction over any dispute arising from them, without prejudice to the Customer's right to approach the competent consumer protection authorities.
